Special education dispute decided in Supreme Court
Tuesday November 15, 2005
"Supreme Court Rules Against Special-Ed Parents!" blare the headlines. It's enough to make you look over your shoulder to see if the feds are coming to nab you now, if as the parent of a child in special education you've been targeted for elimination. In fact, the articles concern a case that came before the Supreme Court to determine whether the burden of proof in IEP disputes should fall on the party who brings the case to court -- usually parents who are contesting a district's plan for their child -- or the party who is defending against it -- usually the school district. To get a better understanding of just what did or didn't get decided in the case of Weast v. Schaffer, read the actual Supreme Court decision and background on past decisions on the Wrightslaw site; an analysis of the case from Cornell University Law School; and a perspective on the issue from special education advocate Reed Martin. Then express your thoughts on the subject in the Parenting Special Needs forum.
