Poll: Is Fetal Alcohol Syndrome Grounds for Child Neglect?

An Oklahoma woman has been charged with child neglect for drinking excessively during her pregnancy and giving birth to an alcohol-addicted child with suspected Fetal Alcohol Syndrome. Do you think FAS should be grounds for such charges? On the one hand, Fetal Alcohol Spectrum Disorders (FASD) are serious, lifelong, and wholly preventable birth defects, caused solely by a pregnant woman's alcohol consumption. If a parent inflicted the kind of brain damage after birth that alcohol consumption does before birth, there would be charges filed for sure. But charging a parent on the basis of prenatal care may set a precedent that could conceivably be applied to poor nutrition, lack of medical care, even abortion. And fear of prosecution may lead new mothers to lie about their prenatal alcohol consumption, denying their children early diagnosis and treatment. Should the charges be applied anyway?
